CHARACTER ART

Have read through my Terms Of Service carefully and in its entirety, as I will refuse your commission if you do not agree to my terms.

I do not consent for my art to be used for AI purposes and alike under any circumstance. I also firmly request that you do not upload my work to any AI sites as this could compromise my business and future projects.

Any form of NFT usage is strictly forbidden.

You must be over 18 in order to be an eligible client.

By commissioning me, you agree that you have read and accepted all the terms described herein.

Violators will be added to my blacklist indefinitely and without warning.

You may use my artwork exclusively for personal use only. This does not include tracing over my artwork in any way or using it as a ‘base’.

You may not claim my work as your own.

Unless previously discussed, I retain all intellectual rights to the artwork. In the case of an adoptable, you retain the rights to the character design.

You are allowed to display my work on external sites as long as it is visibly credited and linked back to me.

You are not permitted to edit, modify or redistribute my art as your own. AI modification is especially not allowed.

Any form of harassment in an attempt to bargain for a commission (a ‘slot’) is not tolerated and I reserve the right to place anyone on my blacklist over harassment.

By commissioning me, you are purchasing my service as an artist only.

I reserve the right to post your finished artwork in my gallery for any reason unless an NDA request was previously discussed.

If the NDA request was broken on the client side, I then reserve the right stated above.

I reserve the right to decline any project or client for any reason.

I reserve the right to refund you the full amount paid if I no longer wish to work on your project for any reason.

If you wish for your request to be private, it must be stated during the ordering process.

The NDA fee usually starts at +5% of the total quote, but it might differ. The bigger the project the bigger the fee.

The privacy request entails that I am not allowed to share any WIPs on social media, nor am I allowed to post the final product anywhere. This means you are not permitted to post the WIPs or final product anywhere, as doing so will break the NDA agreement, thus granting me the right to post it to my own gallery if I so choose.

If you, the Client, wish to order a commission for commercial use, the total price of the commission, as well as any other royalties, will be agreed upon upfront when ordering.

The minimum price increase is 100% of the original price, meaning double the end sum. However, I reserve the right to charge more if I deem fit.

Creation and distribution of digital end products shared to commercial and monetised social and content platform accounts belonging to the Licensee.

Creation, re-selling, and distribution of value-add or derivative digital or physical end products made with the commissioned asset by the Licensee

Creation and distribution of digital and physical content to promote the re-selling of value-add digital or physical end products created by the Licensee

I reserve the right to sign and/or watermark my own work and it will remain on all versions of the artwork sent to the client. You are not allowed to edit or tamper with my watermark/signature in any way. You are not allowed to edit or tamper with my watermark/signature in any way.

I retain all copyright over my work, which includes the right to redistribute, reproduce, or use the artwork as a sample piece for sales or self-promotion unless otherwise agreed upon.

In the case of a commission, I will not claim the rights to a character design unless it was one of my own designs. Therefore I will not reuse/resell the Artwork for personal or commercial projects unless agreed upon.

In the case of an adoptable design, I will not reuse/resell the rights to the design once ownership is transferred to you, the Client.

You are responsible for protecting your ownership over rights to a character design made by me by creating a duplicate image with your name added as additional credit (eg. through watermark) when uploading to external sites.

I accept commissions through PayPal on VGen .

The prices listed on my commission sheets and VGen page are the base prices, however they are subject to change based on the complexity of the piece and the crop you require (eg. headshot / half body / full body).

I’m generally okay with drawing most things, including:

Ecchi / NSFW

Guro & Gore

Backgrounds

Furry (SFW only)

Anything that makes me uncomfortable or not within my skillset, including:

Heavy Mecha

Anything hateful

Extreme fetish art (eg. bara, scat, etc...)

Anything AI or NFT related

Political or Religious propaganda

You are permitted to send me a message via VGen, Discord or Email to ask any questions before placing an order.

Otherwise: You are expected to fill out the details listed on VGen’s service request forms, which will be provided per delegated service.

You will then get a proposal from me where we can discuss the details if further discussion or payment is needed. This is when I will also confirm your slot and give you an estimated timeframe.

If your character is extremely detailed, I have the right to charge a fee to include these details which we will further discuss before I start on your order (as stated above).

You hold the right to make changes to your commission request (eg. change the character / agree to simplified design changes) which may help you to avoid extra fees and payments.

All extra add-ons must be fully paid before I start on your order.

To guarantee the total accuracy of your commission request, please make note of the required details in the initial order through VGen. This will help facilitate a smoother process for both client and artist.

Any emails, private messages and comments that you send must come in English.

After everything is processed and confirmed, I will send you an invoice through VGen with the full payment breakdown, including any add-ons we have discussed which have required extra payments.

Once your invoice has been sent, I will start on your order.

I usually take up to 1-3 days to respond to your initial order inquiry.

I reserve the right to take up to 2 weeks to plan and begin work on your commissions, and an additional 4 weeks to work on said project.

I work on slotted commissions randomly. This means I will work on the piece I’m most inspired by or comfortable with, keeping schedules and deadlines in mind.

You have the right to set a deadline however, this must be disclosed prior to payment.

I have the right to decline a project if there is too short of a time allowance.

If you did not alert me on a deadline, you must not send reminders until my 4 week’s work period has passed.

I will always be communicative about delays and you deserve the right to be notified of them.

If due dates are discussed, it is also the clients’ responsibility to ensure prompt communication. I will not be held responsible for late delivery.

Rush fees are at least 25% of the commission. Fees might vary depending on the project and the timeframe provided.

Estimated project dates are to be discussed during the ordering process and are subject to change. Details are to be discussed should the client have set dates.

In some cases, I am able to accept a rush commission, which would prioritise your request and bring your place in the queue up significantly.

I only accept USD (United States Dollar) via Paypal as payment. VGen should make currency conversion for you during the ordering process. Otherwise, you are responsible for making currency conversions.

You are expected to pay 100% of the price upfront before I start working. No exceptions unless a payment plan has been put into place.

If we agree on a payment plan and I start the commission after the first deposit has been made, I will not refund your deposit if you back out of the payment plan.

If I cancel a project, I will reimburse the lost fees and refund 100%.

I can only refund 100% of the payment BEFORE the work has commenced. You will be notified one day prior to commencement.

Once I start the sketch there will be NO REFUNDS.

Payments via PayPal are sent by invoices unless otherwise stated.

I will cover PayPal fees as it is expected from the artist per PayPal TOS. What you see is what you will have to pay unless extra payments are required during the ordering and discussion stage.

I do not accept payment from shared PayPal accounts.

I am not responsible for any mistakes that are made on your part over the course of the transaction.

If payment is not made in a timely manner (48h) after I've sent you the proposal, the commission will be cancelled.

Repeated counts of commissioning a project and failing to pay will result in blacklisting.

Please note that all of my sales are ‘Digital Artwork’ and it is the Artwork’s ‘Intellectual Property’ that is purchased by you, the Client.

Nothing is ever intended by either me or the Client, to be physically shipped to them.

I am not required to ever ship any item unless it was explicitly discussed.

You are NOT authorized to issue a chargeback for any reason.

If for any reason your PayPal account malfunctions or authorizes a refund request without your knowledge, you must contact me as soon as possible in order to resolve the issue.

You are required to contact me when you need to cancel a commission request.

Purposefully issuing a chargeback without contacting me to cancel/refund a project will result in immediate blacklisting.

I will send the first WIP (Work In Progress) image only after 100% of the payment is completed regardless of the payment plan. These images will come in the form of jpg or png files as an attachment in an email or a DM and would typically be the first sketch.

Each stage counts as a ‘Major Revision’, where the artist and client can discuss feedback and possible changes. Please note that there may be a cost depending on the scope of the change.

You are free to request a WIP at any given time for ‘Minor Revisions’, although please be aware I may not respond straight away as I usually tend to follow through the revision process outlined in the table above and my work hours differ.

Each time I send a WIP to a client, I ask the client to provide feedback to me.

I am not responsible for any unsatisfactory element of the finished design if no feedback was given to amend it.

In the absence of feedback from the customer, any changes to the final piece will be subject to a fee.

The responsibility is on you to ensure your order contains the details you want me to follow.

Changes can only be made during the initial stages stated in the table above. Once we have moved onto the next stage together, any requests to change elements on any previous stage will incur an extra fee.

After the order is completed, minor changes such as color adjustments are allowed if the missing or inaccurate elements are my faults (e.g. I overlooked details provided in the order).

I will not redraw a completed commission unless payment is received for a second order.

You are responsible for saving any information, images and other digital data I provide.

Any file you paid for will be available from me for a finite time only. I preserve files for up to 3 months. However, I cannot guarantee against computer failure or accidental deletion or loss.

There may be slight differences between the samples in my gallery and the illustration you will receive.

I am NOT required to post your project in any public space. If posted, I am not required to keep it there indefinitely. I have the right to delete or remove any public project, even if you paid for it, as you should have your own copy for personal use.

The commissioner must respect that my artistic style cannot be altered.

I reserve the right to reject critiques pertaining to artistic skill and stylisation, especially if said critique reduces the artistic quality of the piece.

Any comments that are rude, inappropriate, inflammatory, and/or non-constructive may result in blacklisting.
